DISTANCE SALES AGREEMENT / MESAFELİ SATIŞ SÖZLEŞMESİ

1. PARTIES / TARAFLAR

1.2. BUYER (ALICI): The person who places an order via the website. (Web sitesi üzerinden sipariş veren kişi.)

2. SUBJECT / KONU

The subject of this Agreement is the determination of the rights and obligations of the parties in accordance with the Turkish Law No. 6502 on the Protection of Consumers and the EU Consumer Rights Directive (2011/83/EU) regarding the sale and delivery of the product(s) ordered by the Buyer from the Seller’s website.

Bu Sözleşmenin konusu, Alıcı’nın Satıcı’ya ait web sitesi üzerinden siparişini verdiği ürünün satışı ve teslimi ile ilgili olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve AB Tüketici Hakları Direktifi uyarınca tarafların hak ve yükümlülüklerinin belirlenmesidir.

3. PRODUCT INFORMATION & PRICE / ÜRÜN BİLGİLERİ VE FİYAT

The type, quantity, brand, model, sales price, and payment method of the products are as stated at the time the order is finalized. Prices include VAT (KDV) unless stated otherwise for international B2B sales.

Ürünlerin türü, miktarı, markası, satış bedeli ve ödeme şekli, siparişin sonlandırıldığı andaki bilgilerden oluşmaktadır.

4. RIGHT OF WITHDRAWAL / CAYMA HAKKI

4.1. Duration: The Buyer has the right to withdraw from this contract within 14 (fourteen) days without giving any reason and without paying any penalty. 4.2. Scope: The 14-day period starts from the day the Buyer or a third party designated by the Buyer receives the goods.

4.1. Süre: Alıcı, hiçbir gerekçe göstermeksizin ve cezai şart ödemeksizin 14 (on dört) gün içinde sözleşmeden cayma hakkına sahiptir. 14 günlük süre, malın teslim alındığı gün başlar.

5. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL / CAYMA HAKKI İSTİSNALARI

The right of withdrawal does not apply in the following cases:

  • Products produced in line with the Buyer’s special requests or personal needs (Customized sizes for Sink Insulation, etc.).

  • Goods that are not suitable for return due to health protection or hygiene reasons if unsealed after delivery.

Aşağıdaki durumlarda cayma hakkı kullanılamaz:

  • Alıcının isteği veya kişisel ihtiyaçları doğrultusunda hazırlanan ürünler (Özel ölçülü eviye yalıtımı vb.).

  • Tesliminden sonra ambalajı açılmış olan ve iadesi sağlık ve hijyen açısından uygun olmayan ürünler.

6. DELIVERY & SHIPPING / TESLİMAT VE KARGO

6.1. The Seller shall deliver the product within 30 days from the order date. 6.2. For EU shipments, customs duties and taxes may apply depending on the country’s regulations, which are the responsibility of the Buyer unless otherwise stated.

6.1. Satıcı, ürünü sipariş tarihinden itibaren en geç 30 gün içinde teslim etmekle yükümlüdür. 6.2. AB gönderilerinde, aksi belirtilmedikçe gümrük vergileri ve masrafları Alıcı’ya aittir.

7. DATA PROTECTION (GDPR & KVKK)

The Seller processes the personal data of the Buyer in accordance with the General Data Protection Regulation (GDPR) for EU citizens and the Law No. 6698 (KVKK) in Turkey. Personal data is used only for fulfilling the order and legal obligations.

Satıcı, Alıcı’ya ait kişisel verileri AB vatandaşları için GDPR, Türkiye’deki kullanıcılar için 6698 sayılı KVKK uyarınca işlemektedir.

8. AUTHORIZED COURT / YETKİLİ MAHKEME

In the implementation of this agreement, Consumer Arbitration Committees and Consumer Courts in the place of residence of the Buyer or Seller are authorized. For EU residents, the Online Dispute Resolution (ODR) platform is available.

Bu sözleşmenin uygulanmasında, Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri yetkilidir. AB’de ikamet edenler için ODR (Çevrimiçi Uyuşmazlık Çözümü) platformu kullanılabilir.
